Product liability class action against EOS lip balm

EOSA class action has been filed in California against the celebrity-endorsed lip balm EOS, claiming the product causes damage to the skin around the mouth. EOS has been used and promoted by Britney Spears and Kim Kardashian, and the company claims the lawsuit is without merit.

Plaintiff Rachael Cronin reported she had a symptoms for 10 days after use, including cracking, bleeding and getting a rash. Other class members stated they had symptoms that lasted for months, or permanently. Cronin’s lawyer Mark Geragos said this could impact tens if not hundreds of thousands of shoppers.

According to the complaint, the plaintiffs are seeking damages to make the consumers whole who have been injured by the product. They hope the trial will answer “whether the Plaintiff and the Class members that purchased EOS Lip Balm suffered monetary, general, consequential, and special damages and, if so, what is the measure of those damages;”…and if they “are entitled to an injunction, damages, restitution, equitable relief and other relief deemed appropriate and the amount and nature of such relief.”
